Lancaster County Clerk of Courts Office

The Lancaster County Clerk of Courts is the chief filing office for the Court of Common Pleas in criminal and juvenile matters. Mary Anater serves as Clerk of Courts. The office records, maintains, and processes criminal and juvenile court records. It also assesses court-imposed costs and fines, and licenses private detectives.

Administrative duties include preparing prison commitments, handling bail, processing motions and petitions, managing summary appeals, and handling appeals to the Pennsylvania Superior and Supreme Courts. The Clerk also processes license revocations and works with PennDOT on driving privilege matters. Documents accepted for filing include warrants, name changes, summary convictions, bonds filed by tax collectors and constables, financial statements, and expungements.

Mail-in requests use Form SP 4-164, sent to the Pennsylvania State Police Central Repository, RCPU, 1800 Elmerton Avenue, Harrisburg, PA 17110-9758. Mail results may take two to four weeks. The Pennsylvania State Police is the only agency authorized to issue certified criminal history background check results in Pennsylvania.

For inmate information, the Pennsylvania Department of Corrections maintains an inmate locator for state correctional facilities. Contact the Lancaster County Prison for local jail inquiries. For municipal arrest records, contact the Lancaster City Bureau of Police or the relevant borough or township police department where the arrest occurred.

Lancaster County Right-to-Know and Open Records

Lancaster County follows Pennsylvania's Right-to-Know Law, which took effect January 1, 2009. Public records are presumed accessible unless a specific exemption applies. Agencies must respond within five business days of receiving a written request. Denial must be in writing with the specific exemption cited.

Many court records are accessible without filing a formal RTK request because they are part of the public court docket. The Open Records Officer at the Office of Court Administration handles court-related public records requests. Non-court county records go through the designated Open Records Officer for each county department. Exemptions apply to sealed records, juvenile files, active investigation materials, and documents containing protected personal data.

Appeals of denied requests can be filed with the Pennsylvania Office of Open Records. The OOR reviews the agency's basis for denial and may order release of records where no valid exemption exists. The burden of proving a record is exempt falls on the agency that received the request.

Lancaster County Court Records: What They Contain

Records that have been expunged by court order are removed from public access. Sealed records are also unavailable through standard requests.
